These Terms set out the rules for using the nimweo.dev website and for the provision of electronic services, in accordance with the Polish Act of 18 July 2002 on the provision of services by electronic means.
§ 1. General provisions
- The nimweo.dev website (the “Site”) is operated by Maciej Mierzejewski (esuu.dev) (the “Provider”).
- Contact with the Provider: [email protected], and the contact form on the Site.
- Using the Site means accepting these Terms.
- Full details of the Provider are in the Legal Notice.
§ 2. Definitions
- User means a person using the Site.
- Electronic Service means a service provided by the Provider by electronic means through the Site, described in § 3.
- Products means Nimweo applications and services (including Nimweo Facility, Accounts, Pulse and Pilot) presented on the Site.
§ 3. Type and scope of services
- Through the Site the Provider enables: (a) browsing information about Nimweo and the Products; (b) sending messages through the contact form, including requests to be told when the Products launch.
- The Electronic Services provided on the Site are free of charge.
- The contact form service is a one-off service and ends when the message is sent or answered.
- Sending the form with the “Product launch news” topic signs the User up for a notice about the launch of the Products. The User’s e-mail address, together with their name, company name (if given) and the site language, is saved in the Provider’s database and used only to send a confirmation of the sign-up and a message about the launch of the Products. The data is kept until that message is sent or the User opts out, and no longer than 24 months from signing up. The User can opt out at any time by writing to [email protected]; details are in the Privacy Policy.
- Information about the Products on the Site is for information purposes and does not constitute an offer within the meaning of Art. 66 of the Polish Civil Code. The Products are under development and not available yet, and the described features may change.
§ 4. Technical requirements
To use the Site you need a device with internet access, an up-to-date web browser with JavaScript enabled and, for the form to work properly, cookie support. The Provider is not liable for being unable to use the Site because these requirements are not met.
§ 5. Rules of use
The User undertakes to use the Site lawfully, in accordance with good practice and these Terms. In particular it is prohibited to:
- submit through the Site content that is unlawful, misleading or infringes the rights of third parties;
- send unsolicited commercial information (spam) or automated submissions through the contact form;
- interfere with the operation of the Site, including by overloading the infrastructure or attempting unauthorised access or circumventing security measures;
- bulk-download Site content by automated means beyond ordinary use.
§ 6. Copyright and marks
The content of the Site (texts, graphics, layout, code) is protected by copyright and belongs to the Provider or is used under a licence. The name Nimweo and the Product names are designations used by the Provider in the course of business. Copying, distributing or otherwise using the content requires the Provider’s consent, except as permitted by law (including fair use).
§ 7. Liability
- The Provider endeavours to keep the Site running without interruption and up to date, but does not guarantee the absence of interruptions (e.g. maintenance) or errors.
- The Provider is not responsible for the content of external sites to which the Site links.
- Nothing in these Terms excludes or limits consumer rights under mandatory provisions of law.
§ 8. Complaints
- Complaints about the operation of the Site or the Electronic Services can be sent to: [email protected].
- A complaint should include contact details of the User and a description of the problem.
- The Provider will consider the complaint within 14 days of receiving it and inform the User of the outcome at the e-mail address provided.
§ 9. Consumers
Nimweo Products are intended for professional (business) use. If, however, the User is a consumer, they enjoy the rights arising from consumer protection law, which these Terms do not limit. A consumer may use out-of-court complaint and redress mechanisms, including the assistance of a county (municipal) consumer ombudsman or consumer organisations, and mediation or an arbitration court at the competent provincial inspectorate of the Trade Inspection.
§ 10. Personal data protection
The rules on processing personal data and on the use of cookies are described in the Privacy Policy and the Cookie Policy.
§ 11. Changes to the Terms
- The Provider may amend the Terms for important reasons, in particular a change in law, the scope of services or security considerations.
- The amended Terms are published on the Site with the date of the update and apply from the date of publication. A change does not affect one-off services begun before it took effect.
§ 12. Final provisions
- Matters not regulated by these Terms are governed by Polish law.
- Disputes with Users who are businesses are resolved by the court competent for the Provider’s place of residence. In disputes with consumers, jurisdiction is determined by generally applicable law. Consumers keep the protection afforded by mandatory provisions of the law of their country of residence.
- The User may stop using the Site at any time.
